1.- Right to information

We inform you that the Platform: https://heydiga.com/en (hereinafter, the "Platform") is owned by HEYDIGA TECH, S.L., (hereinafter, "HEYDIGA"), with tax number B-22.758.122 and registered office at Calle Passeig De Gracia, 50, 5 08007 Barcelona – Spain. Accessing and/or using the Platform gives you the status of User (hereinafter, the "User"), and from that access and/or use you accept this Legal Notice.

2.- Use of the Platform

Users assume responsibility for their use of the Platform. The Platform may provide access to a wide range of texts, graphics, drawings, designs, photographs, multimedia content and information (hereinafter, "Content") belonging to HEYDIGA or to third parties, which Users may access.

Users undertake to make appropriate use of the Content and services offered through the Platform and, by way of example but not limitation, not to use them to:

Engage in unlawful or illegal activities or activities contrary to good faith and public order.
Cause damage to the physical and logical systems of HEYDIGA's Platform, of its suppliers or of third parties.
Introduce or spread computer viruses on the network or any other physical or logical systems liable to cause the damage referred to above.
Attempt to access, use and/or manipulate the data of HEYDIGA, third-party suppliers and other Users.
Reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the Content, unless authorised by HEYDIGA.
Delete, conceal or manipulate Content subject to intellectual or industrial property rights and other identifying data of those rights belonging to HEYDIGA or to third parties incorporated into the Content, as well as the technical protection devices or any information mechanisms that may be embedded in the Content.

HEYDIGA warns that the materials contained on this Platform have been included for information purposes only and are therefore insufficient for taking decisions or adopting positions in a specific case.

Users should bear in mind that the materials contained on this Platform may not reflect the most recent legislative or case-law position on the matters discussed. These materials may also be modified, developed or updated without prior notice.

HEYDIGA will be entitled to investigate and report any of the conduct referred to above in accordance with the law, and to cooperate with the authorities in investigating such conduct.

HEYDIGA may temporarily suspend access to the Platform without prior notice for maintenance, repair, updating or improvement work. However, wherever circumstances allow, HEYDIGA will inform Users sufficiently in advance of the expected date of the suspension of services. HEYDIGA is not responsible for the use Users may make of the Content included on the Platform.

3.- Intellectual and Industrial Property

Each and every intellectual property right in the content and graphic design of this Platform (by way of example, images, sound, audio, video, software or texts; trade marks or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.) is the exclusive property of HEYDIGA and/or of third parties who have formally authorised HEYDIGA to use them. HEYDIGA therefore has the exclusive right to exploit that content and holds all the permissions necessary to use third-party images and information.

Accordingly, under Royal Legislative Decree 1/1996 of 12 April, approving the Consolidated Text of the Intellectual Property Act, and Act 17/2001 of 7 December on Trade Marks, as well as any other supplementary legislation on intellectual and industrial property, the reproduction, transmission, adaptation, translation, distribution or public communication, including making available or any other form of commercial exploitation and/or modification of all or part of the content of the Platform is prohibited without the prior express authorisation of HEYDIGA.

HEYDIGA grants no licence or authorisation to use any of its intellectual and industrial property rights or any other property or right relating to the Platform and/or its services or content.

Users undertake to respect the Intellectual and Industrial Property rights owned by HEYDIGA. Reproduction and temporary storage of the Platform's content is permitted to the extent strictly necessary for the use and display of the Platform from a personal computer, tablet or phone.

The legitimacy of the intellectual or industrial property rights in the content contributed by Users is the exclusive responsibility of those Users, who will answer for any third-party claim arising from unlawful use of the Platform's content.

4.- Data protection

Use of this Platform may require Users to provide personal data. HEYDIGA processes that information in accordance with the applicable legislation, and sets it out in its Privacy Policy.

5.- Liability and Warranties

HEYDIGA states that it has adopted all the technical and organisational measures necessary, within its means and taking account of the current state of technology, to ensure that the Platform works correctly and to minimise the presence of viruses or other harmful elements that could affect Users' computer systems.

However, HEYDIGA cannot guarantee uninterrupted availability or the complete absence of errors in access to the Platform, nor is it responsible for:

any lack of continuity and availability of the Content and Services;
the presence of errors in that Content or the failure to correct any defects that may exist;
the accuracy, completeness or currency of the data provided by Users;
interruption of the Platform's operation or computer failures, telephone faults, disconnections, delays or blockages caused by deficiencies or overloads in telephone lines, data centres, the Internet system or other electronic systems, occurring in the course of its operation;
the presence of viruses or other harmful components;
any damage caused by third parties who breach or circumvent HEYDIGA's security systems.

HEYDIGA assumes no responsibility for the accuracy, completeness or currency of the information provided on the Platform. The information offered is purely informative and is subject to change without prior notice.

HEYDIGA is not responsible for the use Users may make of the Content included on the Platform.

6.- Duration and amendment

This Legal Notice will remain in force indefinitely, and HEYDIGA may make changes to the conditions specified in it, which will take effect from the moment they are published.

HEYDIGA may remove, add or change both the Content and the services it provides, as well as the way in which they appear located or presented. The conditions in force are understood to be those published at the moment the User accesses HEYDIGA's Platform.

Access to and/or use of the Platform will be understood as acceptance by the User of this Legal Notice and its conditions and, where applicable, of any changes made to them.

7.- Hyperlinks

HEYDIGA assumes no responsibility for links to other applications or websites found on HEYDIGA's Platform, which may direct Users to other applications or websites over which HEYDIGA has no control whatsoever.

Accordingly, HEYDIGA is not responsible for the information contained in these third-party links or for any effects that may arise from that information.

The inclusion of links to other websites or applications therefore does not imply HEYDIGA's approval of their content or the existence of any kind of association between HEYDIGA and the owners of those other websites or applications.

Consequently, Users access that Content at their own exclusive risk and under the conditions of use that govern it.

8.- Severability and interpretation

This Legal Notice constitutes an agreement between each User and HEYDIGA.

If the competent authority declares a provision to be unlawful, invalid or unenforceable, that declaration in respect of one or more clauses will be without prejudice to the validity of the remaining clauses.

The fact that HEYDIGA does not require strict compliance with any of the provisions of this Legal Notice does not constitute, and may not in any way be construed as, a waiver on its part of the right to require strict compliance in future.

9.- General Information

HEYDIGA will pursue any breach of this Legal Notice, as well as any improper use of its portal, exercising all the civil and criminal actions available to it at law.

10.- Notices

HEYDIGA may send the relevant communications to the email address provided by Users on registration forms or through any other means provided in the User's contact details.

11.- Languages of this notice

This Legal Notice is published in Spanish, Catalan, English, French, Italian and Portuguese. In the event of any discrepancy between versions, the Spanish version shall prevail.
